Individual Application to the European Court of Human Rights

The European Court of Human Rights is the supervisory body of the European Convention on Human Rights and 47 member states of the Council of Europe are party to this convention. The Republic of Turkey signed the Convention on 4 November 1950 and ratified it with the Ratification Law No. 6366 published in the Official Gazette on 10 March 1954. The ratification document was submitted to the General Secretariat of the Council of Europe on 18 May 1954 and entered into force for Turkey as of that date. The Convention covers a limited number of civil and political rights included in the Universal Declaration of Human Rights, the scope of these rights was later expanded by additional protocols and each protocol is binding on the ratifying state.

Individual applications to the European Court of Human Rights must be made within six months after domestic remedies have been exhausted. However, this period will be reduced to four months when Additional Protocol No. 15 to the Convention enters into force. This protocol was signed on 24 June 2013 but has not yet entered into force. In order for the protocol to enter into force, all party states must ratify the protocol and until this process is completed, applications must be made within six months. The protocol will enter into force within three months after all states have ratified it. Turkey signed Additional Protocol No. 15 on 13 September 2013.

During this process, we check whether domestic remedies have been exhausted, verify that individual applications have been made to the Constitutional Court, examine case files in the courts of first instance, assess the compliance of the application with the admissibility criteria and examine the basis of the intervention that caused the violation. We also carry out procedures such as preparing responses to government views and follow up on the application at the European Court of Human Rights.
